INCREASE IN MINIMUM WAGE AS PER JANUARY 1, 2024

The amounts for the legal minimum wage will be increased by 4.9% effective January 1, 2024.

From that date forward, the legal minimum wage for employees aged 18 and up in fulltime employment will be AWG 1,986.20 per month and AWG 463.25 per week.

For employees aged 18 and up who work more than 22 hours per week as ‘live-in’ home care workers, the legal minimum wage will be raised from AWG 883.35 to AWG 926.65 effective January 1. Where the workweek is less than 22 hours, the legal minimum wage will then be AWG 10.30 per hour (up from AWG 9.85 per hour).

As a result of the minimum wage adjustment, the income limit for purposes of the Labor Ordinance 2013 (Arbeidsverordening 2013) will also be raised effective January 1, 2024. The Labor Ordinance regulates working conditions such as the maximum working hours, rest days, overtime payments, and paid leave. The Labor Ordinance does not apply to all workers, only those who do not exceed the income limit.

The new income limit effective January 1, 2024 is AWG 4,965.50 (the minimum wage of AWG 1,986.20 multiplied by a factor of 2.5). Workers with a monthly salary of AWG 4,965.50 or less, or an annual salary of AWG 59,586.00 or less, will fall under the protection of the Labor Ordinance and may claim all the working conditions that this law provides.
