With the Parliamentary elections in Aruba coming up on September 22, 2017, this e-mail serves to inform you about two obligations that employers have on the basis of the Ordinance on Elections (\u2018Kiesverordening\u2019).<\/p>\n
Obligation to give employees time off in order to vote<\/p>\n
The polling stations will open at 8 AM and will close at 7 PM. Every employee who is eligible to vote is entitled to 4 consecutive hours off between 8 AM and 7 PM on election day. This rule applies unless the employee already has 4 consecutive hours off on other grounds during that time.<\/p>\n
This means for example that an employee who is an eligible voter and who is scheduled to work from 8 AM to 5 PM on election day is entitled to 4 consecutive work hours off. Conversely, an eligible voter who is scheduled to work from 12 AM to 5 PM already has 4 consecutive hours off between 8 AM and 12 PM, and so is not entitled to any time off in order to vote. The same applies to employees who are on sick leave or on vacation on election day.<\/p>\n
Obligation to inform employees who are eligible to vote<\/p>\n
In addition, the employers are required to inform all relevant employees about the precise 4-hour block during which they will be off. This information must be provided at least 1 week before election day.<\/p>\n
Please note that the right to vote is a fundamental right and that failure to comply with these obligations constitutes a criminal offence. <\/p>\n

Con las elecciones parlamentarias en Aruba que se celebrar\u00e1 el 22 de septiembre de 2017, este correo electr\u00f3nico sirve para informarle sobre dos obligaciones que los empleadores tienen acerca de la base de la Ordenanza sobre Elecciones (\u201cKiesverordening\u201d).<\/p>\n
Obligaci\u00f3n de otorgar tiempo a los empleados para votar<\/p>\n
Las mesas de votaci\u00f3n se abrir\u00e1n a las 8 AM y se cerrar\u00e1n a las 7 PM. Cada empleado que es elegible para votar, tiene derecho a 4 horas consecutivas de descanso entre las 8 AM y las 7 PM el d\u00eda de la elecci\u00f3n. Esta regla se aplica a menos que el empleado ya tenga 4 horas consecutivas de descanso debido a otros motivos durante ese tiempo.<\/p>\n
Esto significa por ejemplo que un empleado que es un votante elegible y que est\u00e1 programado para trabajar de 8 AM a 5 PM el d\u00eda de la elecci\u00f3n tiene derecho a 4 horas consecutivas de trabajo. Por el contrario, un votante elegible que est\u00e1 programado para trabajar desde las 12 AM hasta las 5 PM ya tiene 4 horas consecutivas de descanso entre las 8 AM y las 12 PM, por lo que no tiene derecho a tiempo libre para votar. Lo mismo se aplica a los empleados que est\u00e1n de baja por enfermedad o de vacaciones el d\u00eda de las elecciones.<\/p>\n
Obligaci\u00f3n de informar a los empleados con el derecho a voto<\/p>\n
Adicionalmente, los empleadores est\u00e1n obligados a informar a todos los empleados pertinentes sobre el tiempo preciso de 4 horas en el cual estar\u00e1n libres. Esta informaci\u00f3n debe ser proporcionada al menos una semana antes del d\u00eda de la elecci\u00f3n.<\/p>\n
Tenga en cuenta que el derecho al voto es un derecho fundamental y que el incumplimiento de estas obligaciones constituye un delito penal.<\/p>\n
